Recording Clark County Real Estate:
The system for recording and checking title of Clark County, Nevada, Real Estate works fairly well.(Clark County is the county that Las Vegas and its neighboring cities are located in.) Here are some aids:
Timeshare records are not available online.
Mortgages (deeds of trust) and other encumbrances on Clark County Real Estate can not be searched for free online.
If you wish to record a Clark County deed be aware of this quirk: The front page must have absolutely blank one inch margins and a blank 3" square at the upper right. Violations of these rules cost a $25 non-conforming rule. If someone signs their signature such that the first letter of the name intrudes ever so slightly into the one inch margin the $25 non-conforming fee is assessed. Our deed forms have 1.25" margins to reduce the chance of this fee, but we still find many people sign their names with a flourish that extends into the one inch margin.
If you wish to record a deed that transfers property into a trust, the recorder's office will demand to scan a copy of the trust into their computer data base. This is allegedly not a public document. (The recorder's office started scanning rather than just looking at trusts around Aug. 1, 2009.) Most attorneys who write trusts, ourselves included, also give the client an Affidavit and Certificate of Trust which simply states the name of the trust, its address, and who the trustee(s), including successor trustees, are. Most organizations will look at the Affidavit of Trust instead of the Trust if requested. (The inheritance plan of the Trust is not included in the Affidavit of Trust which protects privacy.) However, the Clark County Recorder's Office won't accept the Affidavit and Certificate of Trust unless it states that the trust has not been amended. As lawyers we think this is pretty silly if one is trying to use the Affidavit of Trust to record a deed into the trust only a few days after the Trust's creation. At present they may allow the person offering the Affidavit and Certificate of Trust to hand write in, "This Trust has not been amended."
The recording fee is $14 for the first page and $1 for each additional page. This does not include the transfer tax which may or may not apply.
